Правовое регулирование государственного портового контроля в Российской Федерации

Abstract

В настоящей статье на основе анализа международно-правовых и национально-правовых источников, публикаций, излагаются основные положения государственного контроля в морских портах Российской Федерации. Автор предлагает принять меры по действительному облегчению международного судоходства путем упрощения и снижения до минимума формальностей в соответствии с Конвенцией FAL-65, которые позволят избавиться от простоя судов в ожидании завершения контрольных процедур и начала разгрузочных и погрузочных операций в морских портах. В основном в статье анализируются нормы права, регламентирующие правовое обеспечения государственного портового контроля в морских портах, могущие повлиять на развитие российского торгового мореплавания, привлекательность и конкурентоспособность российских морских портов.

This article on the basis of the analysis of the main international and national law sources describes main provisions of state control in the seaports of the Russian Federation. Author propose to take action on facilitation of international maritime traffic by simplifying and minimizing formalities in accordance with the Convention FAL-65, which will get rid of the idle time of vessels pending the completion of verification procedures and began unloading and loading operations at seaports. Basically, in this article, author emphasize on the norms of the law legislate of port state control, which related with the effectiveness of the organization of Russian commercial navigation, the attractiveness and competitiveness of Russian seaports
