Краткий обзор существующих представлений об элементах криминалистической характеристики

Abstract

В статье рассматривается дискуссионный в науке вопрос о количестве элементов криминалистической характеристики преступлений. Перечислены общепризнанные элементы криминалистической характеристики преступлений, которые достаточно полно характеризуют предмет доказывания. Акцентировано внимание на вопросе о соотношении криминалистической характеристики и обстоятельств, подлежащих доказыванию при расследовании отдельных видов (групп) преступлений. В статье поддерживается мнение некоторых ученых о нецелесообразности включать в число самостоятельных элементов криминалистической характеристики условия охраны предмета преступления от посягательства и обстоятельства, способствовавшие совершению преступления.
