Анализ правового регулирования игр и пари в российском и иностранных правопорядках

Abstract

Статья посвящена особенностям правового регулирования игр и пари в современном гражданском законодательстве стран романо-германской правовой семьи: Германии, Швейцарии, Франции, России и др. Установлено, что регулирование осуществляется либо посредством использования конструкции алеаторных (рисковых) сделок, либо через конструкцию натуральных обязательств. Исследованию подлежат устоявшиеся позиции судебной практики относительно того, что понимается под азартными играми и не подлежит защите.

The article is devoted to the peculiarities of the legal regulation of gaming and betting in the modern civil law countries of the Romano-Germanic legal family: Germany, Switzerland, France, Russia and others. It was found that the regulation is carried out either through the use of design aleatornyh (risky) transactions, or through the construction of natural obligations. Research to be established positions jurisprudence about what is meant by gambling and is not subject to protection.
