Вопросы реформирования досрочного пенсионного обеспечения

Abstract

Анализируются новые направления правового регулирования досрочных пенсий в связи с особыми условиями труда. Стратегия долгосрочного развития пенсионной системы Российской Федерации, утвержденная распоряжением Правительства Российской Федерации от 25 декабря 2012 г. № 2524-р, предусматривает реформирование института досрочных пенсий, установление страховых взносов в Пенсионный фонд по дополнительным тарифам для работодателей, имеющих рабочие места с особыми условиями труда. Кроме того, Стратегия долгосрочного развития пенсионной системы направлена на определение основ формирования и функционирования корпоративных пенсионных систем, а также необходимых условий для обеспечения пенсионных выплат работодателями и принципов государственного контроля в этой сфере. Автор указывает на недостатки в механизме сохранения пенсионных прав. Cделаны выводы о необходимости сохранения государственных социальных гарантий для работников, занятых на производствах с неблагоприятными условиями труда.

This article analyses new trends in legal regulation of early pensions in connection with special working conditions. ‘Strategy for Long-Term Pension System Development in the Russian Federation’, a document approved by Government Directive No. 2524-r on Dec 25, 2012, envisions reforming the institution of early retirement and stipulates increased insurance premiums to be paid to the Pension Fund by providers of jobs with special working conditions. In addition, the document seeks to lay the groundwork for creating and operating corporate pension systems, as well as pre-conditions for employers to provide retirement coverage, and principles of government oversight thereof. The author points out some shortcomings in the mechanism of preserving pension rights. It is concluded that there is need for preserving public social guarantees for workers employed in factories with poor working conditions.
