Поощрение и развитие уважения к правам человека и основным свободам в международном праве и национальном праве России

Abstract

The article contains the analysis of the universally recognized principles and rules of human rights according to which states must encourage and develop the respect for human rights and fundamental freedoms. Basing on the results of the research, the author comes to the conclusion that in modern Russia the incentive rules should be widely used to ensure human and civil rights and it is necessary to improve the efficiency of their influence on individual's rights and motives of behavior.

В статье проводится анализ общепризнанных принципов и норм о правах человека, согласно которым государствами должны осуществляться поощрение и развитие уважения к правам человека и основным свободам. На основе результатов исследования делаются выводы о том, что в современной России необходимо шире применять поощрительные меры в сфере обеспечения прав человека и гражданина, требуется повысить эффективность их воздействия на интересы личности и мотивы ее поведения
