МЕХАНИЗМ РАЗРЕШЕНИЯ СПОРОВ В РАМКАХ ВТО: СТАДИИ, ПРЕДШЕСТВУЮЩИЕ ПЕРЕДАЧЕ СПОРА ТРЕТЕЙСКИМ ГРУППАМ

Abstract

Раскрываются особенности механизма разрешения споров в рамках ВТО, а именно: стадий, предшествующих созданию третейских групп. Проводится анализ процедур взаимодействия между юридическими лицами и государством с целью выявления оснований для обращения в Орган по разрешению споров ВТО, а также консультаций, которые представляют собой первый этап разрешения спора. Особое внимание уделяется эффективности консультаций и их потенциалу в области окончательного урегулирования разногласий.

The article reveals the features of WTO disputes settlement mechanism, in particular the stages preceding panel formation. The interaction procedures of legal entities and state are analyzed in order to reveal the grounds for initiating the procedure in WTO. The article is also focuses on consultations which are the first step in WTO disputes settlement mechanism, their efficiency and potential in the final resolution of conflicts.
