К вопросу о вариативности конституционного принципа федеративного государства

Abstract

В статье автором рассматриваются особенности структуры конституционного принципа федеративного государства, предложена характеристика вариативности принципа разграничения предметов ведения и полномочий между органами государственной власти Российской Федерации и органами государственной власти субъектов Российской Федерации как его неотъемлемого элемента. Сделан вывод о том, что рассматриваемый принцип федеративного государства, как и другие основы конституционного строя, обладает определенной структурой, признаки элементов которой определяют вариативность указанного принципа, взаимосвязанную с фактической реализацией всех составляющих данный принцип нормативно-правовых установлений.

In the course of the research the author considers features of the structure of the constitutional principle, describes the variability of the principle of jurisdiction areas and powers,separation between federal and territorial public authorities of the Russian Federation as its integral element. It is concluded, that the considered principle of the federal state, as well as other bases of the constitutional system, has a certain structure, the features of which determine the variability of the mentioned principle, which in turn is interconnected with the actual realization of all legal components constituting this principle.
