СУДЕБНОЕ ПРАВО ВЕЧЕВОЙ НОВГОРОДСКОЙ РЕСПУБЛИКИ XI-XIII ВВ.: ИСТОРИЯ МЕДИАЦИИ В ДРЕВНЕЙ РУСИ

Abstract

В Великом Новгороде кроме княжеского суда были и некняжеские (альтернативные) судебные институты: вечевой, церковный, третейский (арбитраж), купеческий или торговый суды и просто переговоры спорщиков. Особый их статус в современной историографии не рассматривается в связи с укоренившейся в историко-правовом учении марксистской теории государства, а предпочтение отдается киевской модели права и суда. Альтернативное право Великого Новгорода представлено на основе социально-политической теории государства и культурного плюрализма.

In Veliky Novgorod besides prince law there were alternative (non-prince) judicial institutes: veche, ecclesiastical, arbitral, merchant, and debater negotiations courts. Their unique status isn't given proper consideration in modern historiography because of dominance of Marxist state theory in history and law science. Instead the Kiev model of law and courts is preferred. Alternative law of Veliky Novgorod is based on socio-political theory of the state and cultural pluralism.
