Механизм финансовых гарантий прав и законных интересов туристов: вчера, сегодня, завтра

Abstract

Анализируя положения российского и международного законодательства о туристской деятельности, автор рассматривает особенности обеспечения прав российских туристов на возмещение реального ущерба в случае неисполнения или ненадлежащего исполнения туроператором договора о реализации туристского продукта. Основное внимание уделено процессу трансформации финансового обеспечения ответственности туроператоров в законодательстве Российской Федерации о туристской деятельности.

Analyzing provisions of the Russian and international legislation on tourist activity, the author considers the features of ensuring the rights of the Russian tourists for compensation of the real damage in case of non-execution or inappropriate performance of the contract by a tour operator. Special attention is paid to the transformation of the financial security of tour operators' responsibility in the Russian Federation legislation on tourist activity.
