Abstract

The article provides analysis of the most significant directions in the evolution of the institution of constitutional status of individual and citizen. The author supposes that these directions include on one hand the growing quantity of the proclaimed rights, and widening the scope of the persons entitled to these rights, growing and strengthening of the system of its guarantees on one hand, and on the other hand growth of limitations to the rights and freedoms, as well as constitutional obligations and shrinking of the sphere of application of the equality principle. In the opinion of the author one of the most important factors providing for historical and modern evolution of the legal status of a person is social solidarity. The most scrupulous attention is paid to the tendency for the constant growth of quantity of rights recognized at the constitutional, supranational and international levels of legal regulation.

В статье анализируются наиболее крупные и заметные направления эволюции института конституционного статуса человека и гражданина. Автор полагает, что к числу таких направлений относятся, с одной стороны, количественное увеличение провозглашаемых прав, расширение круга их обладателей, разрастание и укрепление системы их гарантий, а с другой рост числа ограничений прав и свобод, а также конституционных обязанностей и сокращение сферы действия принципа равноправия. По мнению автора, одним из важнейших факторов, обусловливающим историческую и современную эволюцию правового статуса личности, выступает социальная солидарность. Наиболее пристальное внимание в статье уделено такой тенденции развития прав и свобод, как постоянный рост количества прав, признаваемых как на конституционном, так и на наднациональном и международном уровне правового регулирования.
