О правовом нигилизме в российском правосознании: философско-правовой аспект

Abstract

Legal nihilism is regarded as a specific phenomenon of Russian sense of justice, reflecting a negative attitude towards changes at the level of legal traditions mentality. The emergence of it can be attributed to the beginning of the XVIII century, when active Europeanization of Russian culture began as well as the Russian penetration into the justice of the legal traditions of the West. However, the Russian and Western legal traditions have different mental foundation, so the desire to preserve their national and cultural identity within the Russian sense of justice leads to the appearance of such a phenomenon as legal nihilism. It is perfectly reflected in the desire to maintain a close relationship on the worldview level of legal and ethical standards on the basis of relative and absolute values. According to this lawmaking signs of freedom, equality and justice in the Russian sense of justice do not become a formal and legal, as it is typical to the Western tradition of understanding of law, but they gain religious and moral value. Legal nihilism is an explicit rejection of formalization of law, its isolation from the moral and delisting of moral values by the traditional Russian sense of justice.

Правовой нигилизм рассматривается как специфический феномен российского правосознания, отражающий негативное отношение к изменениям на уровне традиции правовой ментальности. Возникновение его можно отнести к началу XVIII в., когда начинается активная европеизация российской культуры и проникновение в российское правосознание правовой традиции Запада. Однако российская и западная правовые традиции имеют разное ментальное основание, поэтому стремление к сохранению своей национально-культурной идентичности в рамках российского правосознания и приводит к появлению такого феномена, как правовой нигилизм. В нем наиболее полно отражается стремление сохранить на мировоззренческом уровне тесную взаимосвязь правовых и нравственных норм по принципу относительных и абсолютных ценностей. В соответствии с этим правообразующие признаки свободы, равенства и справедливости в российском правосознании приобретают не формально-правовое, как это характерно для западной традиции понимания права, а религиозно-нравственное значение. Правовой нигилизм это откровенное неприятие традиционным российским правосознанием формализации права, его обособления от морали и исключения из него нравственных ценностей.
