Abstract

The article contemplates penal-legal issues impeding mens rea proving for illegal migration organisation with the purpose of committing crimes on the territory of Russia. There are propositions introduced concerning the interaction issues between investigating officers and operational personnel during investigations of crimes committed by illegal migrants. The role, position and significance of the operational search activity on combating organized illegal migration crime in Russia are determined. Based on the research on a vast number of judicial decisions there are analyzed signs of criminal organization of illegal migration, settled down relevant recommendations on classification of crime according to the Article 322.1 of the Criminal Code of Russian Federation, including delimitation with adjoining elements.

Рассматриваются вопросы уголовно-правового аспекта, затрудняющие доказывание умысла на организацию незаконной миграции, в целях совершения преступлений на территории России. Вносятся предложения по вопросам взаимодействия следователей и оперативных сотрудников при расследовании преступлений, совершенных нелегальными мигрантами. Определены роль, место и значение оперативно-розыскной деятельности по противодействию организованной преступности в сфере незаконной миграции на территории России. На основе изучения значительного массива судебных решений анализируются признаки преступной организации незаконной миграции, обосновываются соответствующие рекомендации о квалификации преступления, предусмотренного ст. 322.1 УК Российской Федерации, включая разграничение со смежными составами.
