Предпринимательские юридические лица частного права: проблемы отсутствия единого вектора правового регулирования

Abstract

In the article the problems of legal adjusting of the legal entities of Private Law are described. The main goal of these legal entities are the income. It is established, that activity of the legal entities of Private Law can be characterized by different legal systems. This fact requires additional development of the general concepts for standardization of the current legislation. The author has analyzed the general conceptual definition of legislation and science as “company” and “enterprise”. It is argued, that it is vital for the modern science to develop the new conceptual definition as “the enterpreneurial legal entity of Private Law”. This concept may be used for standardization of all forms of the legal entities of Private Law, which are aimed to get the income. These forms of the legal entities of Private Law now are functioning in the different legal flatnesses.

В статье рассматриваются проблемы последовательности и правового регулирования юридических лиц частного права, основной целью которых есть получение прибыли. Установлено, что существующая в сфере деятельности юридических лиц частного права «полисистемность» требует дополнительной разработки общих понятий и конструкций, направленных на унификацию действующего законодательства. Автором проанализированы существующие в законодательстве и доктрине понятия «общество», «предприятие», а также обоснована необходимость разработки «конструкции предпринимательских юридических лиц частного права», использование которой позволит привести к единому знаменателю все организационно-правовые формы юридических лиц частного права, направленные на получение прибыли, и которые функционируют в данное время в разных системах координат.
