Abstract

The article is reflecting the report of the author made at scientific readings, devoted to the memory of prof. S. N. Bratus, which took place at 28th October 2009 in the Institute of legislation and comparative law (Moscow). The problem of the correlation of civil legislation and derivative of it the complex housing legislation is reviewed in the article. The principles of the limitation of the norms between them and concrete redistribution of norms between Housing and Civil codes. The same principle should be implemented also in differentiation of the subject of regulation of civil and complex nature legislation branches.

Статья отражает выступление автора на состоявшихся 28 октября 2009 г. в Институте законодательства и сравнительного правоведения при Правительстве РФ (г. Москва) чтениях, посвященных памяти профессора С. Н. Братуся. Рассматривается проблема соотношения гражданского и производного от него комплексного жилищного законодательства. Предлагаются принцип разграничения норм между ними и конкретное перераспределение норм между Жилищным и Гражданским кодексами РФ. Этот принцип должен действовать также при разграничении предмета регулирования гражданского и комплексных природоресурсных отраслей законодательства.
