От концессии до комплексных долгосрочных контрактов

Abstract

The article is devoted to analysis of recent legislative proposals with a view to the introduction in Russia of the model of comprehensive long-term contracts, which include the design, construction, maintenance of the infrastructure (life cycle contracts (LCC). The discussed for several years already the model of the LCC, apparently, in the nearest future will be legislatively regulated through the introduction of changes to the federal law “About the concession agreements”. The article analyses the proposed positive innovations, as well as formulates thedirection of further improvement of the legislation in order to implement the FTC.

Статья посвящена анализу последних законодательных предложений в целях внедрения в России модели комплексных долгосрочных контрактов, включающих в себя проектирование, строительство, содержание объекта инфраструктуры (контрактов жизненного цикла). Обсуждаемая уже несколько лет модель КДК (К ЖЦ), по всей видимости, в ближайшее время будет законодательно регламентирована посредством внесения изменений в федеральный закон «О концессионных соглашениях». В статье анализируются предлагаемые позитивные нововведения, а так жеформулируются направления дальнейшего совершенствования законодательства в целях внедрения К ДК.
