Принцип недопустимости злоупотребления правом в уголовном судопроизводстве

Abstract

Исследуются понятие принципа, его признаки и свойства и проводится сравнительное исследование данного понятия с такой правовой категорией, как недопустимость злоупотребление правом. Прослеживается соотношение принципа недопустимости злоупотребления правом с иными принципами уголовного судопроизводства.

The notion of this concept, its characteristics and properties are analyzed. Comparative analysis of the notion with the legal category as res judicata is performed. The relation between res judicata and other principles of criminal procedure is observed.
