Развитие уголовно-правовых мер разрешения обстряющегося противоречия между государством и коррупцией

Abstract

It is not authorities or service interests that need legal protection, but the activity of realization of state functions that need criminal-legal protection. Corruption counteraction should be accepted as a separate function of a state. It is conceptually important to stress the incompatibility of power and corruption. Any concession, any compromise, or institutionalization of trading in public interests lead to ruining the state. That proves that corruption counteraction is possible only by strengthening the state control over authorities.

В уголовно-правовой охране нуждаются не власть и интересы службы, а деятельность по осуществлению государственных функций. Противодействие коррупции следует признать в качестве самостоятельной функции государства. Концептуально важно подчеркнуть несовместимость власти и коррупции. Любая уступка, компромисс, институализация торговли публичным интересом приводят к разрушению государства. Изложенное позволяет утверждать, что противодействие коррупции возможно только путем усиления государственного контроля над властью.
