Abstract

The article is devoted to the categories of public interests and public needs within the inter-branch regulation of the civil liability of public entities and their officials. Legal regulations of different branches of the Russian law are also analysed, but there is made a conclusion about the civil nature of liability of public entities and their officials as a measure of balance between private and public interests.

В статье анализируются понятия «публичные нужды» и «публичные интересы» в контексте отношений, связанных с участием в гражданском обороте публичных субъектов. Затрагиваются нормы иных отраслей российского права, но делается вывод о гражданско-правовом характере норм о гражданско-правовой ответственности публичных субъектов как средстве поддержания баланса частных и публичных интересов.
