Особые законы субъектов Российской Федерации: возможная конституционно-правовая трактовка

Abstract

The article contains an attempt to generalize points of view, which were made in scientific literature about the special laws of subjects of the Russian Federation. According to the authors the position it is possible to reference to such laws the regional constitutions (charters), the laws, change constitutions (charters), and also the regional organic laws (as the laws, which adopted on the direct instruction of the constitution (charter). The definition of the concept «special law of the subject of the Russian Federation» is given, distinctive features and properties of considered laws are described.

Предпринята попытка обобщить имеющиеся в научной литературе взгляды на особые законы субъектов Российской Федерации. Автором отстаивается позиция о возможности отнесения к таким законам региональных конституций (уставов), законов, изменяющих конституции (уставы), а также региональных органических законов законов, принимаемых по прямому предписанию конституции (устава). Приводится дефиниция понятия «особый закон субъекта Российской Федерации», описываются отличительные черты и свойства рассматриваемых законов.
