К вопросу о классификации и проблемы понятия источника повышенной опасности

Abstract

The article dwells on the analysis of the notion referring to a source of enhanced danger, subjects and objects of its classification: the author raises the question concerned with a responsibility for inflicting harm through a source of enhanced danger. The author considers also the normative instruments regulating a correlation between an sinflicted harm and responsibility in case, a source of enhanced danger being involved; scientific conclusions are suggested.

Статья посвящена анализу понятия источника повышенной опасности, ее субъектов и объектов классификации, основам появления ответственности от нанесения вреда посредством источника повышенной опасности. Автор также рассматривает нормативные акты, регулирующие соотношение вреда и ответственности. Обобщается судебная практика нанесения вреда посредством источника повышенной опасности и предлагаются научные выводы.
