Abstract

В статье проанализированы существующие точки зрения относительно принадлежности института особого мнения судьи Конституционного Суда РФ о толковании Конституции РФ к доктринальному или компетентному неофициальному толкованию Основного закона. Рассмотрены коллизии, обусловленные особенностями правового положения субъекта такого толкования.The author analyzed the existing views on the membership of the Institute dissenting opinion of Judge of the Constitutional Court on the interpretation of the Constitution of the Russian Federation to doctrinal or competent informal interpretation of the Basic Law. Considered a conflict due to the peculiarities of the legal status of the subject of such an interpretation.
