Особенности правовой защиты нематериальных благ в странах англосаксонской правовой семьи

Abstract

Статья посвящена изучению особенностей правового регулирования неимущественных отношений в странах англосаксонской правовой семьи. Автором было проведено исследование значения категории «бестелесная вещь» в правовых системах семьи общего права, проанализированы смежные термины, используемые для обозначения бестелесных вещей («incorporeal property», «intangible property (assets)», «intangible hereditament»). Рассмотрены отдельные способы защиты личных неимущественных прав. В результате исследования были сделаны следующие выводы. Во-первых, свойственное римскому праву деление объектов (вещей) на телесные и бестелесные нашло свое специфическое отражение и в странах общего права. Указанное свидетельствует о существующей на сегодняшний день объективной потребности урегулирования общественных отношений, объектом которого выступает нематериальное благо. Во-вторых, большинство нематериальных благ, признаваемых таковыми в российском праве, в странах общего права не рассматриваются отдельно от их прав. Правовая защита нематериальных благ устанавливается путем закрепления в нормах личных неимущественных прав и последующим созданием с помощью прецедентного права эффективных механизмов их защиты. В-третьих, несмотря на то, что в законодательстве стран общего права отсутствует такой термин, как «нематериальное благо», правовая защита нематериальных благ осуществляется с помощью иных институтов, таких как «Intangible property», «Incorporeal property», «личные права».

The article is devoted to the study of peculiarities of legal regulation of property relations in countries of Anglo-Saxon legal family. The author conducts a study of the concept of "immaterial thing” in the Common Law legislations, analyzes related terms used to refer to intangible things ("incorporeal property", "intangible property (assets)," "intangible hereditament"). The article considers separate ways of protection of personal non-property rights. As a result of the study, the following conclusions were drawn. Firstly, division of objects (things) into material and immaterial, which is common for Roman Law, is also specifically present in common law countries. The above said proves that today there is an existing objective need in the regulation of public relations, the object of which is intangible benefit. Secondly, the majority of intangible benefits, recognized as such in Russian law, in common law countries are not considered distinct from their rights. Legal protection of intangible benefits is established by consolidating the norms of non-property rights and the subsequent creation of effective mechanisms for their protection through the case law. Thirdly, despite the fact that the legislation of the common law countries has no such a term as "intangible benefit", legal protection of intangible products is carried out by other institutions, such as "Intangible property", "Incorporeal property", "personal rights".
