Abstract

Данная статья представляет собой рецензию на научное издание, посвященное такому законодательному памятнику советского уголовного права, как Советское уголовное уложение, к сожалению, по сути, неизвестное современному криминалисту. Уложение рассматривается как исторический источник, отражающий взгляды определенной категории ученых-юристов, отстаивающих принцип преемственности в праве. Дается оценка сделанного авторами анализа основных положений теории уголовного права, сложившихся к началу XX в. и их отражения в нормах Советского уголовного уложения. В статье указывается на актуальность исследования, а также подчеркивается, что работа представляет интерес как для представителей юридической науки в сфере уголовного права и источниковедения, так и для историков права, изучающих советский период его развития.

The article presents a review on the scientific publication, which is devoted to an outstanding document of Soviet criminal law, which is the Soviet Criminal Charter. The said Charter is mostly unknown to the modern criminal law scholars. The Charter is regarded as a historical source, reflecting the views of a certain category of legal scholars, supporting the continuity in law. The reviewers evaluate the analysis of the key provisions of criminal law theory, which were formed by the early XX century, and their reflections in the provisions of the Soviet Criminal Charter. The reviewers point out the topicality of the study, and it is noted that the study is of interest to the legal scholars majoring in criminal law and source studies, as well as to historians studying Soviet period of legal development.
