Особенности правового регулирования третейских судов в странах англо-саксонской и романо-германской правовых систем: сравнительно-правовой анализ

Abstract

Проводится сравнительно-правовой анализ нормативного регулирования третейских судов в зарубежных странах. Рассматривается проблема определения правовой природы института третейских судов в странах англо-саксонской и романо-германской правовых систем. Исследуются основные элементы, определяющие специфику моделей правового регулирования деятельности третейских судов в зарубежных странах, в частности дается характеристика источников правового регулирования третейских судов, третейского соглашения, компетенции третейских судов, природы решения третейского суда. Сформулированы основные критерии, на основании которых можно определить особенности правовых моделей третейских судов в странах англо-саксонской и романо-германской правовых систем. Сделан вывод, что в настоящее время в зарубежных странах сформировались две модели третейского разбирательства: договорная в странах англо-саксонской правовой системы и процессуальная в странах романо-германской системы. Договорная модель третейского судопроизводства характеризуется созданием отдельных нормативно-правовых актов, не входящих в процессуальное законодательство, высокою ролью норм договорного права. Процессуальной модели третейского судопроизводства свойственно включение норм о третейских судах в процессуальное законодательство; приравнивание юридической силы третейского суда к силе судебного решения.

Comparative legal analysis of arbitration courts in foreign countries is given. The problem of determining the legal nature of the institution of arbitration courts in Anglo-Saxon and Romano-Germanic legal systems is considered. The basic elements that define the specificity of models of legal regulation of arbitration courts in foreign countries, in particular, the sources of legal regulation of the arbitration courts, the arbitration agreement, the competence of arbitration courts, the nature of the arbitral award is considered. The basic criteria by which to determine the characteristics of legal models of arbitration courts in the Anglo-Saxon and Romano-Germanic legal systems are formulated. It is cconcluded that at the present time in foreign countries two models of arbitration are formed, negotiated in the Anglo-Saxon legal system and procedural countries Romano-Germanic system. Negotiated arbitration model is characterized by the creation of a separate legal acts non-procedural legislation, high role of treaty law. Procedural model arbitration has the inclusion rules on arbitration courts in procedural law; equating legal force to the force of the Arbitration Court judgment.
