Abstract

В работе предпринята попытка осмысления правовой сущности арбитража применительно к современному развитию правовой системы в России. Анализируется проект закона «О третейских судах и арбитраже (третейском разбирательстве) в Российской Федерации», обобщается судебная практика, а также мнения цивилистов относительно целесообразности реформирования законодательства. Сравнительное исследование отечественного и зарубежного законодательства позволяет сформулировать ряд выводов относительно оптимальности конструирования российского законодательства

In this article is attempt to comprehend the legal essence of arbitration in relation to the modern development of the legal system in Russia. We analyze the draft law «On commercial arbitration courts and arbitration (commercial arbitration proceedings) in the Russian Federation», is generalized judicial practice, as well as opinions on the advisability jurist law reform. Comparative study national and foreign legislation allows formulating some conclusions regarding the optimal design of the Russian legislation.
