Основания для оспаривания решений, действий или бездействия органов публичного управления Великобритании в порядке судебного контроля

Abstract

Действия и решения органов публичной власти могут оспариваться в порядке судебного контроля. Нарушение различных публично-правовых принципов может заставить суд сделать вывод, что принявший решение орган действовал незаконно. Все основания для судебного контроля подразделяются на три категории: незаконность, иррациональность и неправомерность в связи с процессуальными нарушениями, каждое из которых подробно рассматривается в данной статье. Исследование основано на значительном количестве судебных прецедентов по данной категории дел.

Public bodies acts and decisions may be challenged before a court by the way of judicial review. The breach of the different public law principles may amount a court to the conclusion that the decisionmaker had acted unlawfully. All grounds for judicial review are subdivided into three categories: illegality, irrationality and procedural impropriety, each of them is considered particularly in this article. The investigation is based on a number of judicial review cases.
