О необходимости повышения эффективности наказаний, назначаемых несовершеннолетним преступникам

Abstract

The problems of the application of criminal punishments to the minor criminals are examined. Analyzing the system of punishments for the minor the author reveals the essence of each of them. Special attention is paid to the contradictions of criminal law, to the conditionality and reservations, which decrease the effectiveness of the punishments in question. The changes, introduced into the system of punishments for the minor, did not show essential preventive and educational action on the teenage criminality. For the purpose of the more effective application of the acting punishments the author proposes the number of changes and additions, which make it possible to achieve the goals of punishment. The new form of punishment not connected with the deprivation of freedom is proposed also.

Рассматриваются проблемы применения уголовных наказаний к несовершеннолетним преступникам. Анализируя систему наказаний для несовершеннолетних, автор раскрывает сущность каждого из них. Особое внимание уделяется противоречиям уголовного закона, условностям и оговоркам, которые снижают эффективность рассматриваемых наказаний. Изменения, внесенные в систему наказаний для несовершеннолетних, не оказали существенного предупредительного и воспитательного воздействия на подростковую преступность. С целью более эффективного применения действующих наказаний автор предлагает к ним ряд изменений и дополнений, позволяющих достичь целей наказания. Предлагается также новый вид наказания, не связанный с лишением свободы.
