Особенности ответственности за причинение вреда здоровью человека в уголовном законодательстве европейских стран

Abstract

В статье представлены уголовно-правовые положения зарубежного законодательства об ответственности за причинение вреда здоровью. Автор обращает внимание на то, что в правовых реалиях динамично развивающегося современного общества появляются новые, структурно более сложные формы уголовноправовых норм об охране здоровья человека. В связи с этим, в статье проводится теоретико-правовое исследование юридической природы, понятия и содержания уголовного законодательства об ответственности за причинение вреда здоровью человека в результате незаконного проведения биомедицинских исследований, применения запрещенных способов диагностики и лечения, а также лекарственных средств, за незаконные генетические манипуляции и клонирование человека.

The article gives criminal provisions of foreign legislation on the responsibility for causing injury. The author pays attention to the fact that in legal reality of dynamism of modern society there are new more complicated forms of criminal regulations of personal health protection. In this connection the article gives theoretical and legal analysis of legal nature, notion and content of criminal legislation on the responsibility for causing personal injury following illegal biomedical testing, use of prohibited methods of diagnostics and treatment as well as drugs, illegal genetic manipulations and human cloning.
