Abstract

В статье раскрывается уголовно-правовое значение категорий преступлений, удельный вес которых в числе регистрируемых в стране составляет около трех четвертей. На основе анализа действующего уголовного законодательства делаются выводы о достаточно многообразном отражении такого значения в различных институтах уголовного права, о схожести уголовно-правового значения преступлений небольшой и средней тяжести, с одной стороны, и заметной обособленности их от значения тяжких и особо тяжких преступлений, с другой. Обращается внимание на несовершенство уголовного закона в рассматриваемом вопросе, предлагается ограничить круг деяний, признаваемых малозначительными, только теми, которые формально подпадают под признаки преступлений небольшой или средней тяжести.

The article explores the meaning of the criminal law categories of crimes, their share in the number registered in the country being about three-quarters. Based on analysis of existing penal laws conclusions are drawn on diverse reflection of their values in the various institutions of criminal law, the similarity of weight of criminal law offenses ranging from small to moderate, on the one hand, and their isolation from the visible weight of grave and especially grave crimes, on the other hand. The author draws attention to the shortcomings of the criminal law in the matter, it is proposed to limit the range of acts recognized as insignificant, only to those that fall under the formal signs of crime small or moderate.
