Международные связи субъектов федераций в свете судебной практики

Abstract

В статье впервые в отечественной науке рассматривается судебная практика по вопросам внешних связей субъектов федераций. Эти вопросы связаны с разграничением полномочий между федеральной властью и властью субъектов федераций в сфере международных и внешнеэкономических связей, с правовым статусом субъектов федераций как участников международной жизни, с защитой прав обеих сторон в федеративных отношениях. На основе судебной практики обосновывается вывод о необходимости одновременного обеспечения верховенства федеральной власти в области внешней политики и международных отношений и прав субъектов федераций на участие в международных и внешнеэкономических связях в пределах своей компетенции.

The article views court practice on problems of distribution of powers between federal authority and federal subunits in such spheres as foreign links, legal status of federal subunits as participants of international affairs, and defense of rights of the both subjects of federal relations. Conclusion is made that it is necessary to secure supremacy of federal authority in foreign policy and international affairs simultaneously with rights of federal subunits to participation in international and foreign economic links in framework of their competence.
