О некоторых вопросах применения института смягчающих обстоятельств при назначении наказания за мошенничество в сфере кредитования

Abstract

The article deals with the application of norms for the mitigating circumstances, demonstrating positive post-criminal behavior, to the persons having committed fraud in lending. It is noted that the unconditional recognizing confession, partial confession or limited remedy as mitigating circumstances generally fail to meet the requirement of the significant effect of such circumstances on the weakening of responsibility. The author states the necessity for formulating by the Plenum of the Supreme Court of the Russian Federation the principles of taking into account those circumstances, which are not included into the list in part 1 clause 61 of the Criminal Code of the Russian Federation.

В статье рассматривается практика применения норм института смягчающих наказание обстоятельств, свидетельствующих о позитивном постпреступном поведении, к лицам, совершившим мошенничество в сфере кредитования. Отмечается, что безусловное признание смягчающими таких обстоятельств дела, как признание вины, частичное признание вины или частичное возмещение ущерба в большинстве случаев не соответствует требованию значительности влияния таких обстоятельств на изменение уголовной ответственности. Отмечается необходимость формулирования Пленумом Верховного Суда РФ принципов учёта в качестве смягчающих тех обстоятельств, которые не входят в перечень, закреплённый в ч. 1 ст. 61 УК РФ.
