Abstract

One of the unresolved questions is the problem of making a list of persons having the right for acquaintance with the protocol of the trial after the end of the trial in a criminal case. The article advocates a position about the need to put in the code of criminal procedure a rule governing the composition of the participants in the criminal process, with the right, indicating the list of eligible participants meets in full, and parties entitled to familiarize themselves with the Protocol in part related to their testimony or other participation in the proceedings. Bearing in mind that in criminal proceedings the parties to the conflict do not often possess or poorly possess the language of the proceedings, the author justifies the proposal for the introduction of the translator's duty to be acquainted with the Protocol of the trial where he or she was involved in the case if one of the parties to the conflict does not possess the language of the proceedings. The author asserts the position that the translator must get acquainted immediately with the composed part of the Protocol of the trial in order to prove the correctness and propriety of held records.

Одним из неразрешенных является вопрос о составе лиц, имеющих право на ознакомление с протоколом судебного заседания после окончания судебного разбирательства по уголовному делу. В статье указывается на необходимость ввести в УПК РФ норму, регламентирующую состав участников уголовного процесса, имеющих указанное право, и включить в неё перечень участников, имеющих право знакомиться с протоколом судебного заседания в полном объеме, и участников, имеющих право ознакомления с протоколом в части, касающейся их показаний, или иного участия в судебном разбирательстве. Учитывая, что в уголовном судопроизводстве достаточно часто стороны конфликта не владеют или недостаточно владеют языком судопроизводства, в статье обосновывается предложение о введении обязанности переводчика знакомиться с протоколом судебного заседания в случаях, если он участвовал по делу ввиду не владения языком судопроизводства одной из сторон конфликта. Отстаивается позиция, что переводчик должен знакомиться незамедлительно с составленной частью протокола судебного дабы удостоверить правильность и корректность проведенных записей.
