The problems of legislative regulation of authorities of the head of the body in charge of preliminary investigation are considered in the article. Peculiarities of the legal status in the bailiff service are formulated. The legal acts, regulating the rights and duties of the head of the body in charge of preliminary investigation in the system of the Federal Bailiff Service, have been analyzed and the gaps in the legislation have been pointed out. A number of proposals on expansion the authorities of the head of the organ in charge of preliminary investigation in the field of procedural control of investigation proceedings, with granting him the powers on the abolishment of illegal and unfounded enactments of the investigator included are submitted.

В статье рассмотрены вопросы законодательной регламентации полномочий начальника органа дознания. Определены особенности его правового статуса в службе судебных приставов. Проанализированы правовые акты, регламентирующие права и обязанности начальника органа дознания в системе ФССП, выделены пробелы в законодательстве. С учётом правоприменительной практики внесены предложения о расширении полномочий начальника органа дознания в сфере процессуального контроля за производством дознания, в том числе о предоставлении ему полномочий по отмене незаконных и необоснованных постановлений дознавателя.
