Abstract

Орган по разрешению споров ВТО обладает наибольшим авторитетом в области рассмотрения международных торговых споров и достаточными интеллектуальными ресурсами: членами третейских групп и арбитрами данного органа, как правило, являются крупнейшие в мире специалисты в области международного торгового права. Для достижения порядка в области международной торговли Орган по разрешению споров ВТО не должен оставаться в стороне от тех конфликтов, с которыми сталкиваются страны, не входящие в состав ВТО. Взаимное сотрудничество с иными международными и региональными органами правосудия позволит выработать такие подходы к практике международной торговли, которые будут способствовать консолидации и согласованности норм международного права, а также повышению эффективности международного судопроизводства. В статье проведен анализ механизма урегулирования споров в области международной торговли, оценена роль и перспективы развития Российской Федерации в процессе его реализации, рассмотрена деятельность основных органов, в компетенцию которых входит разрешение международных торговых споров, и на основе этого предложены пути совершенствования указанного механизма на территории стран постсоветского пространства, в частности государств членов Евразийского экономического сообщества.

The paper considers the Dispute Settlement Body of the WTO that has the highest authority in addressing international trade disputes and possesses sufficient intellectual resources: members of the panels and arbitrators are as a rule the world's experts in the field of international trade law. To ensure order in the international trade the Dispute Settlement Body of the WTO should not stay out of the conflicts faced by countries that are not members of the WTO. Mutual cooperation with other international and regional bodies of justice will help develop universal approaches to the international trade that will contribute to the consolidation and harmonization of international law as well as improve the efficiency of international justice. The paper analyzes the mechanism of dispute settlement in international trade, examines the role and prospects of the mechanism for the development of the Russian Federation, and considers the activity of the main bodies that resolve international trade disputes. In conclusion the authors suggest ways to improve this mechanism in the post-Soviet countries, in particular members of the Eurasian Economic Community.
