Проблемы наследования прав, связанных с участием в отдельных организационноправовых формах юридических лиц

Abstract

The article discusses the basic theoretical and practical problems of inheritance of a share (equity unit) in the charter (pooled) capital of economic partnerships and companies, production cooperatives. The author proposes to expand on the Art. 1176 of the Civil Code of the Russian Federation with the clause regulating the moment when a heir becomes a sharer of the legal entity.

В статье рассмотрены основные теоретические и практические проблемы наследования доли (пая) в уставном (складочном) капитале хозяйственных товариществ и обществ, производственных кооперативов. Автор предлагает дополнить ст. 1176 ГК РФ пунктом, регулирующим момент, с которого наследник становится участником юридического лица.
