
Анализируются правовой режим самовольных построек, процедуры и основания признания права собственности на такие постройки, их сноса. Рассматриваются особенности гражданского и арбитражного процессов по такой категории дел. По результатам анализа делается вывод о том, что законодательное регулирование этого вопроса рамочное, толкования различными юристами некоторых законодательных актов противоречат друг другу, судебная практика не унифицирована. Автор предлагает редакции изменений в соответствующие законодательные акты.
Analyzes the legal regime of unauthorized constructions, procedures and grounds for recognition of ownership of the buildings, their demolition. The features of civil and arbitration process for this category of cases. The analysis concludes that the legal framework regulating this issue, different legal interpretations of some laws contradict each other, the jurisprudence is not uniform. The author proposes editorial changes to the relevant legislation.
