Поводы и основание принятия решения о применении уголовно-процессуальных мер безопасности к участникам досудебного уголовного судопроизводства

Abstract

The paper considers prerequisites (grounds) for solving a problem by a junior detective, an investigator, a head of investigative body or a court on the use of security measures established in Section 3 of Article 11 of the Criminal Procedure Code of the Russian Federation. The list of reasons for making a decision on the application of criminal procedure security measures is analyzed. Particular attention is paid to regulations of the Criminal Procedure Code in terms of safety measures for citizens, who are involved in criminal proceedings. The author concludes that security measures can be taken not only in respect of participants in the process, i.e. citizens whose criminal procedure status has already been determined, but other participants who are involved in criminal procedure relations.

В статье рассмотрены предпосылки (поводы и основание) для решения вопроса дознавателем, следователем, руководителем следственного органа или судом о применении мер безопасности, которые установлены в в ч. 3 ст. 11 УПК РФ. Анализу подвергается перечень поводов принятия решения о применении уголовно-процессуальных мер безопасности. Особое внимание уделяется изучению норм УПК, устанавливающих условия обеспечения мер безопасности в отношении граждан, которые вовлекаются в сферу уголовного судопроизводства. Автор приходит к выводу о том, что меры безопасности могут быть приняты в отношении не только участников процесса, то есть граждан, уголовно-процессуальный статус которых уже определен, но и иных участников, которые вовлечены в сферу уголовно-процессуальных отношений.
