Abstract

В статье рассматривается вопрос о процессуальном статусе лица, в отношении которого велось или ведется производство о применении принудительной меры медицинского характера: его правах, процессуальных гарантиях и механизме их реализации. Заявленная тема исследуется с учетом изменений в уголовно-процессуальном законодательстве, внесенных Федеральным законом от 29.11.2010 г. № 323-ФЗ «О внесении изменений в Уголовно-процессуальный кодекс Российской Федерации». Производится анализ указанного нормативного правового акта, и предлагаются отдельные рекомендации по его применению на практике.

The article is devoted to the issue of procedural status of the person being under the proceedings on the application of the compulsory medical measures: his rights, procedural safeguards and mechanisms of their implementation. This issue is examined with an allowance for changes in the criminal procedure legislation made by the Federal law of 29.11.2010, № 323-FL On the alteration in the Code of criminal procedure of the Russian Federation The legal act is analyzed and the recommendations of its use in practice are offered.
