Abstract

The problem of complex legal structure in corporate disputes of arbitration courts is described. The main attention is paid to consideration of procedural peculiarities of corporate disputes in arbitration courts at the presence of complex legal structure (for example, the legal personality of a legal entity and the conclusion of the contract). The author on the basis of the analysis of the judicial practice proves practically significant proposals of the possibility of going beyond the stated requirement in corporate disputes in the presence of complex legal structure. The possibility of estimation of the court of individual acts for challenging transactions is suggested

Рассмотрена проблема сложного юридического состава в корпоративных спорах, рассматриваемых в арбитражных судах. Основное внимание автор уделяет рассмотрению процессуальных особенностей рассмотрения корпоративных споров в арбитражных судах при наличии сложного юридического состава (например, правосубъектность юридического лица и заключение договора). Автор на основе анализа судебной практики обосновывает практически значимые предложения о возможности выхода за пределы заявленных требований в корпоративных спорах при наличии сложного юридического состава
