Критический анализ постановления конституционного Суда Российской Федерации от 14 июля 2015 года № 21-п

Abstract

In this article the author critically examines the well-known and resonant decision of the Constitutional Court, which raises the problem of the possibility of execution of decisions of intergovernmental bodies, in particular the European Court of Human Rights. The author identifies and examines the reasons which led the Constitutional Court to take such a decision, and also analyzes the position of the Court in terms of the Constitution of the Russian Federation and international legal regulations. At study end, the author concludes that the main reasons of the Court are extremely unconvincing and contradictory in terms of the doctrine and practice of international law.

В данной статье автор критически анализирует известное и резонансное решение Конституционного Суда Российской Федерации, в котором поднимается проблема возможности исполнения решений межгосударственных органов, в частности Европейского Суда по правам человека. Автор выявляет и рассматривает причины, побудившие Конституционный Суд принять такое Постановление, а также анализирует позиции Суда с точки зрения Конституции Российской Федерации и международно-правовых нормативных актов. В конце исследования автор приходит к выводу, что основные доводы Суда являются крайне неубедительными и противоречивыми с точки зрения доктрины и практики международного права.
