The article deals with the issue of settlement of corporate disputes in arbitration court. This mechanism should be referred to an extrajudicial procedure, since the arbitration court is not included in the general system of courts in the Russian Federation. The right of participants of the review of corporate disputes in arbitration court may be implemented in case of an arbitration agreement, which may be a separate contract or a separate agreement or condition contained in the Charter of the organization. It should be noted that the arbitration clause contained in the Charter does not apply to new members of society. At the same time, the legislation clear answer to the question is no data. It would be true to fix legislatively the spread of the arbitration agreement on the new members of society if they are familiar with it and with the written consent indicating its application.

В статье рассматривается вопрос о разрешении корпоративных споров в третейском суде. Данный механизм следует отнести к внесудебной процедуре, так как третейский суд не входит в общую систему судов в Российской Федерации. Право участников о рассмотрении корпоративных споров в третейском суде может быть реализовано в случае заключения третейского соглашения, которое может представлять собой отдельный договор или отдельное условие договора, либо содержаться в уставе организации. Следует отметить, что третейская оговорка, содержащаяся в уставе, не распространяется на новых участников общества. При этом в законодательстве четкого ответа на данный вопрос нет. Было бы верным закрепить законодательно распространение арбитражного соглашения на новых участников общества при условии их ознакомления с ним и с письменным указанием согласия его применения.
