Abstract

The article explores the legal regulation and the essence of the dissenting opinion of the judge of the Constitutional Court of the Russian Federation, stated with the disagreement of the judge as a whole or with separate provisions of the reasoning part of the decision rendered by the Court. The conducted monitoring of the practice of constitutional legal proceedings in the most urgent and resonant cases in which the judges of the Constitutional Court of the Russian Federation presented their dissenting opinions allowed the authors to reveal the peculiarities of the legal nature of the institution under study, as well as the problems of its regulation and implementation.

В статье исследуется правовая регламентации и сущность особого мнения судьи Конституционного Суда РФ, излагаемого при несогласии судьи в целом или с отдельными положениями мотивировочной части решения, выносимого Судом. Проведенный мониторинг практики конституционного судопроизводства по наиболее актуальным и резонансным делам, в которых судьи Конституционного Суда РФ излагали свои особые мнения, позволил авторам выявить особенности правовой природы исследуемого института, а также проблемы его регламентации и реализации.
