Принцип состязательности: понятие и свойства

Abstract

The author reveals the properties of the concept of «adversarial procedure», examines the controversial issue of the relationship between the adversarial principle and the establishment of truth in the studies of the criminal procedure. The article also analyzes the circumstances of the case and evaluates the role of a court sentence for an adversarial procedure.

Раскрыты свойства понятия «состязательность», проанализирован спорный вопрос науки уголовного процесса о соотношении принципа состязательности с установлением истины в уголовном процессе. Дан анализ фактических обстоятельств дела, а также оценена роль приговора суда для состязательного процесса.
