Abstract

Данная статья посвящена частно-публичному порядку привлечения к уголовной ответственности в связи с совершением преступлений, предусмотренных главой 23 УК РФ. В результате последних изменений норма о таком порядке была исключена из Уголовного кодекса РФ и оставлена лишь в Уголовно-процессуальном кодексе. Путем анализа смысла данной нормы автор приходит к выводу, что ее содержание и причины ее появления являются исключительно уголовно-правовыми. Статья предназначена для студентов и аспирантов, преподавателей и научных работников, специализирующихся на уголовном праве.

This article deals with privat-public prosecution of crimes, listed in Chapter 23 of Criminal Code of Russian Federation. Under the latest amendments rules of prosecution of such crimes were removed from the Criminal Code to the Criminal Procedure Code. After analyzing the rules, author comes to conclusion that content and grounds of the rules appear to be of the Criminal law nature. The article is intended for criminal law students, postgraduate students, professors and scholars.
