К вопросу об особенностях статуса вновь избранного и не вступившего в должность Президента Российской Федерации

Abstract

Автор, анализируя действующее законодательство, приходит к выводу, что содержание статуса вновь избранного и не вступившего в должность главы государства фактически полностью состоит из правовых привилегий, при этом остальные его аспекты остаются не урегулированными. Автор также полагает недостаточным уровень подзаконного нормативного правового регулирования данного института и предлагает принятие специального Федерального закона «О статусе вновь избранного Президента РФ» либо включение соответствующих норм в будущий Федеральный конституционный закон «О Президенте РФ».

Analyzing existing legislation the author comes to the conclusion that status of President elect consists only of legal privileges and other aspects stay unregulated. The author of the article considers the level of sublegislative regulation of this institute to be insufficient and suggests adoption of Federal law "the Status of Re-elect President of the Russian Federation" or embodying the corresponding norms in future Federal Constitutional Law "the President of the Russian Federation".
