О роли «Мягкого» международного права в регулировании межгосударственных отношений по предупреждению и преодолению финансовоэкономических кризисов

Abstract

Цель: Исследование влияния актов «мягкого» международного права на международные отношения в сфере предупреждения и преодоления финансово-экономических кризисов. Методология: В работе применялись формально-юридический, сравнительный и структурно-логический методы. Результаты: В статье рассматриваются вопросы влияния рекомендательных международных актов на регулирование межгосударственных отношений по поддержанию финансово-экономической стабильности. Определено, что в настоящее время акты «мягкого» международного права способствуют формированию единообразного понятийного аппарата в сфере антикризисного сотрудничества, частично находящего закрепление в юридически обязывающих документах. Кроме того, рекомендательные акты, как основа регулирования отношений по предупреждению и преодолению финансово-экономических кризисов, представлены в большей мере на универсальном уровне, где договорное согласование воли не всегда достижимо вследствие разницы экономических интересов государств. Учитывая общепризнанность, время существования и практическую применяемость положений отдельных рекомендательных актов по поддержанию финансово-экономической стабильности, предлагается рассматривать их в качестве международных обычаев, т. е. источников международного права. Новизна/оригинальность/ценность: Впервые в отечественной науке международного права осуществлена попытка выявить роль «мягкого» международного права в регулировании межгосударственных отношений по предупреждению и преодолению финансово-экономических кризисов.

Purpose: To analysis the impact of acts of soft international law on international relations in the field of preventing and overcoming the financial and economic crises. Methodology: the formal legal, comparative, structural and logical methods. Results: This article analyzes the impact of recommendation of international instruments to regulate interstate relations to maintain financial and economic stability. Determined that currently acts soft international law, contribute to the formation of a uniform conceptual apparatus in the field of anti-crisis cooperation, in part by securing a legally binding document. In addition, reference acts as the basis for regulating relations in the prevention and resolution of financial and economic crises, represented largely on the universal level, where the contractual agreement will not always possible due to the difference of economic interests. Given the general acceptance, the existence and the practical applicability of the provisions of the acts of the individual recommendation to maintain financial and economic stability, it is proposed to consider them as international customs, that is sources of international law. Novelty/originality/value: It is that the nation’s first science of international law made an attempt to identify the role of soft international law in the regulation of interstate relations to prevent and overcome the financial and economic crises
