Проведение примирительных процедур как мера поощрения позитивного постпреступного поведения несовершеннолетних

Abstract

The paper examines reconciliation with the victim as a form of postcriminal behavior of juvenile defendants whereby it is possible to implement conciliation procedures with the participation of a mediator. An algorithm of the investigator’s actions is proposed for the cases when the accused and the victim agree to go through conciliation procedures. The author also proposes some changes to the legislation that would facilitate the use of "conciliation procedures" at the preliminary inquiry stage.

Рассматривается форма постпреступного поведения несовершеннолетнего обвиняемого примирение с потерпевшим, в ходе которой возможно осуществление примирительных процедур с участием посредника. Предлагается алгоритм действий следователя при согласии обвиняемого и потерпевшего пройти примирительные процедуры. Автором предлагаются изменения в законодательстве, способствующие использованию на стадии предварительного расследования «примирительных процедур».
