Abstract

В статье рассматриваются создаваемые различными ветвями органов государственной власти предпосылки к возникновению у граждан и их объединений желания осуществлять не возложенные на них законодательно правоохранительные функции. Такие ситуации возникают при расхождении положений, зафиксированных в нормах права, и существующих в обществе моральных представлений о способах восстановления социальной справедливости. Причем подобные деяния, хотя и выполняются криминальными методами и носят явно противозаконный характер, тем не менее, часто являются социально одобряемыми и поддерживаемыми населением.

In article are considered created by various branches of public authorities of the precondition to emergence at citizens and their associations of desire to carry out legislatively law-enforcement functions not assigned to them, committing thereby crimes. Such situations arise at a divergence of the provisions recorded in rules of law, and existing in the society of moral ideas of ways of restoration of social justice. And such acts, though are carried out by criminal methods and have obviously illegal character, nevertheless, often are socially approved and supported by the population.
