Now Russian Federation does not recognize de facto marriage. The number of these unions (also use another terms: cohabitation, non-marital cohabitation, concubinage, unmarried partnership, domestic partnership, de facto union, de facto relationship, personal relationship…) is increasing steadily. This article is about drawing up of the de facto marriage. There are some opinions on this problem. The possibility of drawing up of the de facto union by contract has been reviewed in that article. Now there is no special legal contract of regulating and drawing up the relationships between de facto spouses. Some contacts can be entered by de facto spouses now. These contracts (like an agreement of ownership in common, a contract of society in participation (or contract of joint activity), contract of houses use) are entered by anyone, not only by de facto spouses. The problem of entering the marriage contract or the similar contact to the marriage contract by cohabitations has been also examined in the article. The problem of designing the de facto marriage contract has been analyzed in the article. The merits of this contract have been pointed out. The purpose, the form, the order and distinction of entering this contract also has been offered. The content of the de facto marriage contract is not the subject of this article.
