Методология эффективной реализации уголовной ответственности

Abstract

В статье анализируется методология эффективности уголовной ответственности, рассматриваются наиболее актуальные проблемы реализации отдельных ее видов, направления совершенствования, их полное соответствие принципам, целям и задачам уголовного закона. Автор исследует содержание Уголовного кодекса относительно рассматриваемых понятий и делает выводы об их оптимизации. Публикатор вносит предложения по методике правильной квалификации преступлений в контексте повышения эффективности уголовной ответственности.

The article analyzes the methodology of effectiveness of criminal responsibility, considers the most actual realization problems of its separate types, perfection directions, their complete correspondence to principals, aims and tasks of criminal law. The author researches the content of Criminal Code about scrutinized notions and concludes about their optimization. The author makes offers on methodology of right crime qualification in context of effectiveness rise of criminal responsibility.
